Revisions to Pricing Law target e-commerce companies

On Thursday, the macro planner (NDRC) and market regulator (SAMR) released draft revisions to the Pricing Law for public comment.

The good news: The proposed changes include a ban on platform companies – such as e-commerce marketplaces – forcing retailers to sell below cost.

The not-so-good news: The draft revisions do little to address involution-style competition and price wars plaguing China’s industrial sectors, from autos to solar and beyond.

What happens next: The period for public comment runs through August 23.

  • The NDRC and SAMR will then finalize the revisions and submit them to the State Council for review.
  • Once approved, the draft will go through at least two rounds of deliberation by the legislature (NPCSC) – meaning it won't become law until Q1 2026 at the earliest.
